AKRON PLANE CRASH

By | Plane Accidents | No Comments

Recent Akron, Ohio Small Plane Crash Has Boca Raton Connection

Devastating tragedy leaves loved ones with many questions and no answers

On November 10th, a chartered jet carrying seven passengers and two pilots crashed in a residential neighborhood in Akron, Ohio. All nine onboard died in the crash. Fortunately, no one on the ground was injured despite the plane crashing into a four-unit apartment complex. The seven passengers on the jet were all employees of Pebb Enterprises, a family-owned Boca Raton commercial real estate company. Florida-based ExecuFlight operated the chartered Hawker 700 plane.

Following a tragedy such as this, family and friends are left wondering how something like this could happen. Unfortunately, answers are usually difficult to come by, and investigations are long and tedious. The National Transportation Safety Board (NTSB) investigates all aviation accidents that occur in the United States. In 2013, there were a total of 1,298 civil aviation accidents across the country that caused 429 fatalities. This includes

  • Commercial cargo and passenger air carriers
  • Commuter and on-demand carriers
  • General aviation such as powered parachutes and light-sport aircraft

High-profile, commercial airline accidents tend to receive the most attention both from the media and investigators. Small aircraft accident investigations; however, require the same level of knowledge, skill and attention-to-detail to ensure that all facts and possible causes are analyzed.

It is still too early in the investigation to know exactly what transpired in the moments before the Akron plane crash or what may have caused this tragedy. Not knowing how or why these events occurred is often one of the most stressful and emotionally trying aspects of the experience for victims’ family members. During this time, there are often many confusing obstacles that may arise throughout the investigation. It is important to have a staunch advocate on your side to get the answers and results you deserve.

In many cases, it may be necessary to take extra steps to ensure that all aspects of the investigation are fully explored. Our aviation litigation attorneys go the extra mile to work with all parties involved and consult with top aviation accident experts to get a complete picture of what happened before, during and after the crash. Understanding Florida’s Motorcycle Law

By | Car Accidents | No Comments

A comprehensive guide to the ins and outs of legally operating a motorcycle in the Sunshine State

Florida’s climate and seemingly endless sunny days are irresistible to the thousands of licensed motorcycle operators throughout the country. Motorcyclists are subject to additional rules and regulations and it is important to be well-versed in these laws before you take to the roads.

Those wishing to operate motorcycles must pass an additional Basic Rider Course offered through the Florida Rider Trainer Program to have a motorcycle endorsement added to their standard Class E license. Florida has reciprocal privileges for motorcyclists that have obtained endorsement in another state excluding Alabama.

In addition to additional licensing requirements, Florida motorcycle law also dictates when proper equipment and headgear is to be worn. Motorcyclists are required to wear protective headgear unless he or she 21 years of age or older and has at least $10,000 in medical insurance for injuries.

Motorcyclists are subject to the same traffic laws as other motorists. It is unlawful to operate a motorcycle if your Blood Alcohol Content (BAC) is .08 or greater. If you are convicted of driving a motorcycle under the influence of drugs or alcohol, you may face:

  • Mandatory license suspension
  • Community service
  • Probation
  • Hefty fines
  • Jail time

The severity of punishment varies depending on the driver’s prior history of DUI convictions and the seriousness of the injuries resulting from the accident. Motorcycles are inherently dangerous and operators and riders are more vulnerable to suffering serious injuries. The most common injuries associated with motorcycle accidents include:

  • Traumatic brain injuries and concussions
  • Broken bones
  • Lacerations, bruises and road burns
  • Neck and spinal cord injuries

If you or a loved one has been involved in a motorcycle accident, we have the answers to all your legal questions and are ready to guide you through the process of obtaining compensation. Call 561-293-2600 or contact us online to schedule a free consultation at our Boca Raton office.

Wrong Way Accidents On the Rise

By | Car Accidents | No Comments

As wrong-way driver accidents increase, so do personal injury and wrongful death lawsuits against at-fault parties

Recently, it has been nearly impossible to watch an evening newscast without hearing about another, often fatal, wrong-way accident. The National Transportation Safety Board (NTSB) issued a report in 2012 after conducting a lengthy special investigation into the number of occurrences and contributing factors relating to wrong-way crashes. From 2004-2009, there were 1,566 fatal wrong-way accidents that occurred on divided highways leading to 2,139 fatalities.

Even though the number of wrong-way crashes may be less than the overall number of vehicle accidents, wrong-way crashes are head-on collisions and are, by their very nature, more dangerous. A vast majority of wrong-way crashes occur on access ramps and high speed highways at night. Further contributing to the inherently serious nature of wrong-way crashes, a large majority of wrong-way drivers are found to be impaired by drugs or alcohol at the time of the accident. In many cases, these drivers also had a prior history of DUI convictions.

Many communities are establishing task forces and community response groups to address the growing problem of wrong-way accidents. Improved highway interchange and access ramps are one of the key areas where advancements are necessary. Larger, pre-lit signs with visible warnings to advise drivers that they are traveling against the legal flow of traffic also contribute to preventing avoidable accidents.

If you are involved in an accident with a wrong-way driver, it is important to explore your options and protect your best interests.
